Copyright & IP Policy

1. Introduction

This Copyright & Intellectual Property Policy ("Policy") explains how MediaOrb (Pty) Ltd t/a LinkDeck ("we", "us") handles intellectual property matters on the LinkDeck platform ("Platform").

2. Our Intellectual Property

The Platform, including its source code, design, branding, logos, documentation, and all related materials, is the intellectual property of MediaOrb (Pty) Ltd. This includes:

  • The LinkDeck name, logo, and brand assets.
  • Platform software and architecture.
  • Theme designs and templates.
  • Documentation and marketing materials.

You may not copy, modify, distribute, sell, or create derivative works from any of our intellectual property without prior written consent.

3. Your Intellectual Property

You retain full ownership of content you create and upload to the Platform, including:

  • Text, images, and media files.
  • Business information and branding.
  • Links and product listings.

By uploading content, you grant us a limited, non-exclusive, worldwide licence to host, display, and distribute that content solely for the purpose of providing and operating the Platform.

This licence terminates when you remove the content or close your account, subject to reasonable backup and caching periods.

4. Copyright Infringement Claims

We respect the intellectual property rights of others. If you believe that content on the Platform infringes your copyright, you may submit a takedown notice to us.

4.1 Takedown Notice Requirements

A valid takedown notice must include:

  1. Identification of the copyrighted work you claim has been infringed.
  2. Identification of the infringing content on the Platform, including the URL.
  3. Your contact information (name, address, email, phone number).
  4. A statement that you have a good-faith belief that the use is not authorised by the copyright owner.
  5. A statement that the information in the notice is accurate, under penalty of perjury.
  6. Your physical or electronic signature.

4.3 Counter-Notice

If you believe your content was removed in error, you may submit a counter-notice including:

  1. Identification of the content that was removed.
  2. A statement under penalty of perjury that you have a good-faith belief the content was removed by mistake.
  3. Your name, address, and phone number.
  4. Consent to the jurisdiction of the courts of South Africa.
  5. Your physical or electronic signature.

5. Repeat Infringers

We may terminate the accounts of users who are repeat copyright infringers. We track and investigate all takedown notices and take appropriate action.

6. Trademarks

The LinkDeck name and logo are trademarks of MediaOrb (Pty) Ltd. You may not use our trademarks without our written permission, except as necessary to accurately refer to our services.

Similarly, you must not use the Platform to infringe on the trademarks of any third party.

7. Open-Source Components

The Platform may include open-source software components. These components are subject to their respective licences, which are available upon request.
