Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the LinkDeck platform ("Platform"), operated by MediaOrb (Pty) Ltd t/a LinkDeck ("we", "us", "our"), a company registered in the Republic of South Africa (Registration No: 2021/142574/07).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Definitions

  • "Account" means a registered user account on the Platform.
  • "Content" means any text, images, links, media, or other material uploaded, published, or displayed through the Platform.
  • "Tenant" means a user-created page or profile on the Platform.
  • "Subscription" means a paid plan providing access to premium features.
  • "User" means any person who accesses or uses the Platform.

3. Eligibility

You must be at least 18 years of age or the age of legal majority in your jurisdiction to use the Platform. By registering, you represent that you meet this requirement.

4. Account Registration

To access certain features, you must create an Account. You agree to:

  • Provide accurate and complete information during registration.
  • Keep your login credentials secure and confidential.
  • Notify us immediately of any unauthorised use of your Account.
  • Accept responsibility for all activity that occurs under your Account.

5. Use of the Platform

You may use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Platform for any illegal or unauthorised purpose.
  • Violate any applicable law or regulation, including South African law.
  • Upload or distribute harmful, offensive, or infringing Content.
  • Attempt to gain unauthorised access to any part of the Platform.
  • Interfere with or disrupt the Platform's infrastructure.
  • Use automated tools (bots, scrapers) without prior written consent.

6. User Content

You retain ownership of Content you upload to the Platform. By uploading Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and distribute that Content solely for the purpose of operating the Platform.

You are solely responsible for ensuring that your Content does not violate any third-party rights or applicable laws.

7. Subscriptions and Payments

Certain features require a paid Subscription. By subscribing, you agree to:

  • Pay the applicable fees as displayed at the time of purchase.
  • Automatic renewal unless cancelled before the renewal date.
  • Our Subscription & Refund Policy.

All payments are processed through our third-party payment provider (PayFast) and are subject to their terms.

8. Platform Role and Merchant Responsibility

LinkDeck is a software platform. We provide tools for businesses ("Merchants") to build and manage their own business pages, including the ability to accept payments, display products, and sell tickets or services.

LinkDeck is not the seller, merchant, or merchant of record for any goods or services sold by a Merchant through their LinkDeck page. When you purchase from a business on LinkDeck:

  • The contract of sale is between you and that individual business, not with LinkDeck or MediaOrb (Pty) Ltd.
  • The Merchant is solely responsible for fulfilling your order, processing returns or refunds, and providing customer support for your purchase.
  • Payments for Merchant goods and services are processed directly through the Merchant's own payment gateway account (e.g. their own PayFast merchant account). LinkDeck does not receive, hold, or process those funds.
  • For any queries about an order placed on a Merchant's page, please contact that business directly using the contact details shown on their page.

9. Free Trial

We may offer a free trial period. At the end of the trial, your account will revert to the free plan unless you subscribe to a paid plan. We reserve the right to modify or discontinue trial offers at any time.

10. Intellectual Property

The Platform, including its design, code, branding, and documentation, is the intellectual property of MediaOrb (Pty) Ltd. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our written consent.

11. Termination

We may suspend or terminate your Account at any time if you breach these Terms. Upon termination:

  • Your right to access the Platform ceases immediately.
  • We may delete your Content after a reasonable notice period.
  • Any outstanding fees remain payable.

You may terminate your Account at any time by contacting us or using the account settings.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the maximum extent permitted by South African law, MediaOrb (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.

Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless MediaOrb (Pty) Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Platform. Continued use after changes constitutes acceptance of the updated Terms.
